Terms of service

Draft. This text is a working draft pending legal review, and the company details are still to be confirmed. It describes how Auctiqo works today; it will be updated before launch.
These terms are the agreement between you and Auctiqo (legal name, tax ID (CIF) and registered address to be confirmed) for using the Auctiqo website and platform. By creating an account you accept them. If you use Auctiqo for a sale room, you accept them on its behalf and confirm you're allowed to.
1. The service
Auctiqo is a platform for auction houses: a sale-room website, catalogues, commission bids, a live bidding board, settlement, a CRM, email marketing and related tools. We keep improving it, so features may change; we won't remove a core feature you pay for without telling you in advance.
2. Your account
- You need a valid email address, which you confirm before your first sign-in.
- Keep your password to yourself and tell us straight away if you think someone else has used your account.
- Each agent uses their own account; accounts can't be shared.
3. Plans and billing
- Free is free, with no card needed and no time limit.
- Solo (one seat) costs €29 / month, billed annually, or €39 / month, cancel any time.
- Team costs €49 / month, billed annually, or €69 / month, cancel any time, for up to 3 seats, plus €12 / month per extra seat, up to 5 seats.
- Prices exclude VAT (IVA), which is added where it applies.
- Annual plans are paid in advance for the year. Monthly plans can be cancelled at any time and run to the end of the paid month.
- We'll give you at least 30 days' notice of any price change, which applies from your next billing period.

4. Your content
You own what you put into Auctiqo: your lots, photos, texts and client data. You give us permission to host, copy, display and send it only as needed to run the service for you, for example publishing your catalogue. You're responsible for having the rights to what you upload and for your lots being accurate and lawful.
For personal data about your clients, you are the controller and Auctiqo is your processor: we process it only on your instructions, keep it confidential and secure, use only the sub-processors listed in our privacy policy, and help you answer data-subject requests (GDPR article 28). A separate data processing agreement is available on request.
5. Acceptable use
Don't use Auctiqo to:
- send spam or emails to people who haven't agreed to hear from you;
- publish listings or content that are false, misleading, discriminatory or unlawful;
- try to break, overload or get around the security of the platform, or access other people's accounts or data.
We may suspend accounts that break these rules, and we'll tell you why unless the law prevents it.
6. Third-party services
Where Auctiqo publishes your catalogue to third-party sites, those sites accept and show your lots under their own terms. We're not responsible for their decisions or availability.
7. Availability and liability
We work to keep Auctiqo available and your data safe, but we can't promise the service will never be interrupted. To the extent the law allows, our total liability to you in any 12-month period is limited to what you paid us in that period, and we're not liable for indirect losses such as lost profits or sales. Nothing in these terms limits liability that can't be limited by law.
8. Ending the agreement
You can close your account at any time. We can end the agreement with 30 days' notice, or straight away for a serious breach of these terms. When an account closes you can export your data for 30 days; after that we delete it, except what we must keep by law.
9. Law and disputes
These terms are governed by Spanish law. The courts of the defendant's domicile have jurisdiction, unless mandatory consumer rules say otherwise.
